We follow the Information Privacy Principles set out in the Privacy Act 2020 (or any legislation that replaces it) (the Privacy Act) and all other applicable laws. This Privacy Policy applies in addition to, and does not limit, our rights and obligations under the Privacy Act and other applicable laws.
2. Who we are
In this Privacy Policy, “we”, “us” and “our” mean The Mortgage Advisers, the operator of themortgageadvisers.co.nz, and the Financial Advice Provider you engage with for advice and transactional services, acting through a Financial Adviser.
Mortgage advice is provided by Sarah Hood (FSP1003498) on behalf of Designer Mortgages (2002) Limited, trading as Loan Market Sarah Hood (FSP734471). That Financial Advice Provider is a member of The Loan Market Group and operates under the financial advice provider licence held by NZ Financial Services Group Limited (FSP286965). 3. Your authorisation
By giving us personal information, submitting an enquiry form on this website, engaging us to provide services or using this website, you consent to the collection, use, storage and disclosure of your personal information as described in this Privacy Policy.
4. Changes to this Privacy Policy
We may change this Privacy Policy from time to time to reflect changes in the law or in our business, provided the changes do not disadvantage you. The current version will always be published on this page. By continuing to engage with us or use this website, you will be taken to have accepted the updated Privacy Policy.
5. What personal information we collect
Personal information is information that identifies you, or is capable of identifying you. It includes, for example, your name, date of birth, address, contact details, account details and occupation.
When you send an enquiry through this website we collect your name, phone number, email address, the type of help you are looking for and anything you choose to tell us in your message.
If you engage us to provide services, we may also collect information about your financial situation and goals, such as your income, expenses, assets, debts and deposit, so that we can recommend the mortgage and insurance products we are permitted to advise on (Products).
6. Why we collect your personal information
We collect your personal information so that we, and the relevant third parties described in section 9, can provide services to you and manage our relationship with you. For example, we use it for:
- responding to your enquiries and requests, including booking your free chat;
- providing services to you, such as assessing your position and recommending Products;
- sending you communications and direct marketing about products and services we think may interest you, by mail, telephone or electronic means (including email and SMS/MMS);
- market research; and
- any other purpose authorised by you or by the Privacy Act.
If you do not want to receive marketing information, you can opt out at any time by letting us know.
We may also collect personal information (including credit information and health information) on behalf of the lenders, insurers and other providers of the Products you choose to apply for (Product Providers). Product Providers have their own privacy policies, which apply to the information we collect on their behalf.
7. How we collect your personal information
Generally, we collect your personal information directly from you. This includes the details you submit through the enquiry forms on this website, information collected through your use of the website, and information you give us by phone, email or in conversation with us.
We may also collect your personal information from:
- NZ Financial Services Group Limited (trading as Loan Market and Insurance Market) (Loan Market) and its related bodies corporate;
- credit reporting agencies;
- with your authorisation, banks (for example, through bank statement retrieval services such as illion Bank Statements) and employers;
- Product Providers, for example during the term of any loan or insurance we have arranged for you, so that we can answer your questions or help with your financial arrangements as your circumstances change. Where applicable, Product Providers may also periodically disclose your loan balance or premium to us in connection with the payment of ongoing commission to us over the term of your loan or insurance; and
- any other person authorised by you or by the Privacy Act.
If we collect your personal information from someone other than you, we will take reasonable steps to tell you about the collection and the matters the law requires as soon as reasonably practicable, unless an exception under the Privacy Act applies.
If you give us personal information about anyone else (for example, a partner, co-borrower or guarantor), you confirm that you collected that information in accordance with the Privacy Act and that the person concerned:
- has authorised you to disclose it to us, and has authorised us to collect, use and disclose it in accordance with this Privacy Policy; and
- has been told of their right to access, and request correction of, their personal information.
8. Keeping your personal information up to date
We generally rely on you to make sure the information we hold about you is accurate. If any of your details change, please let us know as soon as you can.
9. Who we disclose your personal information to
Where we consider it necessary for the purposes described in section 6, we may disclose your personal information to:
- Loan Market and its related bodies corporate;
- Product Providers and other prospective lenders, third parties or intermediaries in relation to your finance or insurance requirements (including a prospective lender's mortgage insurer (if any), any person a lender or insurer proposes to enter into contractual arrangements with, any person who provides a guarantee or security, and any trustee, assignee or potential assignee of a lender's or insurer's rights);
- our referral partners who can help you with other services;
- our contractors and service providers, including the providers who host this website and deliver our enquiry forms and email;
- investors, any entity with an interest in our business, or any entity to which we consider assigning or transferring any of our rights or obligations, or selling all or part of our business;
- anyone we are legally required or authorised to share your information with, including regulators and government agencies;
- auditors (such as Loan Market), to make sure the services we provide are in your best interests and comply with current regulations;
- your employer and referees, and credit reporting and identity verification agencies; and
- any other person or entity authorised by you or by the Privacy Act.
Sharing with NZ Financial Services Group Limited (NZFSG). We share personal information with NZFSG because we are a member of its financial services group. This includes information you give us directly, and information we collect or create while working with you, including your identity, contact details and sensitive financial data. This sharing enables us to provide our services to you and allows NZFSG to meet its monitoring, oversight and assurance obligations under the Financial Markets Conduct Act 2013 and the Privacy Act. NZFSG acts as an agency collecting and holding this information. You can read its full privacy policy, including its physical address and how to exercise your rights to access and correct your information, at www.nzfsg.co.nz/privacy-policy. This sharing is a condition of our service: if you do not agree to it, we cannot provide services to you, because NZFSG's oversight is a condition of our membership of its financial services group.
You acknowledge and agree that credit reporting agencies may hold your credit information (including default information) on their systems and use it to provide their credit reporting services, which may include providing your credit information (including default information) to their customers.
Before we disclose any of your personal information to another person or organisation, we will take all reasonable steps to satisfy ourselves that they have a commitment to protecting your personal information that is at least equal to ours.
10. Disclosure outside New Zealand
We may use cloud storage to store the personal information we hold about you. The cloud storage and the IT servers used may be located outside New Zealand.
We may also disclose personal information to Loan Market and its related bodies corporate, and to third-party suppliers and service providers located overseas, for some of the purposes listed above.

Enquiry forms
The “Book a Free Chat” and enquiry forms on this website ask for your name, phone number, email address and a short description of what you need help with. We use those details to contact you about your enquiry and to provide our services, as described in this Privacy Policy.
Cookies and IP addresses
When you visit this website, we may send a “cookie” (a small file containing a unique ID number) to your device. This allows us to recognise your device each time you visit. We may also use cookies and similar analytics tools to measure traffic patterns, see which areas of the website have been visited, analyse trends, administer the website, track how visitors move through it and gather broad demographic information. 12. Do you have to give us personal information?
You are not required to give us any personal information. If you choose not to, it may affect our ability to provide services to you and your ability to obtain finance, insurance and other Products from Product Providers.
In most circumstances we will need to identify you in order to do business with you. Where it is lawful and practicable, we will offer you the opportunity to deal with us without providing personal information, for example if you make a general enquiry about interest rates or current promotional offers.
You can browse this website anonymously, but we will not be able to contact you unless you provide your details.
13. Accessing and correcting your personal information
You may access, and ask us to correct, any of the personal information we hold about you at any time by contacting us. We may charge a fee to cover our reasonable costs of retrieving and supplying the information to you.
